1. Using Our Services
By accessing our website, programs, written materials, audio/video sessions, or courses (collectively, the “Services”), you agree to use them responsibly, respectfully, and in compliance with all applicable laws and instructions provided by PeakVox coaches or facilitators. You must not misuse the Services, interfere with their operation, attempt unauthorized access, or engage in behavior that could harm other participants or the PeakVox community.
You are responsible for ensuring that your use of the Services is appropriate for your circumstances. If you participate in group sessions, you agree to maintain a supportive environment, follow session guidelines, and avoid harassment, discrimination, or disruptive conduct.
2. Eligibility, Accounts, and Communications
You represent that you have the legal capacity to enter into these Terms. If you create an account or register for a course, you agree to provide accurate information and to keep it updated. You are responsible for maintaining the confidentiality of any login credentials and for all activity that occurs under your account.
By contacting PeakVox or registering for Services, you may receive transactional communications related to your requests, purchases, access instructions, scheduling, and policy updates. Marketing communications, if any, are subject to applicable consent requirements and your ability to opt out where required by law.
3. Purchases, Access, and Refunds
Some Services may be offered for purchase, including time‑limited access to digital content or scheduled sessions. Unless otherwise stated at the time of purchase, access may be granted for a fixed term and may be revoked upon expiration, cancellation, chargeback, or violation of these Terms.
You agree not to copy, reproduce, distribute, publicly display, sell, resell, share credentials, or otherwise provide unauthorized access to paid content. PeakVox may suspend or terminate access if it reasonably believes your account is being used in an unauthorized manner.
Refund policies, if offered, are described at checkout or in related purchase communications. If no refund terms are presented, purchases are considered final to the extent permitted by law. Nothing in these Terms limits any non‑waivable consumer rights that may apply in your jurisdiction.
4. Intellectual Property
The Services and all content provided by PeakVox—including text, exercises, lesson plans, session structures, branding, designs, and media—are owned by PeakVox or its licensors and are protected by intellectual property laws. PeakVox grants you a limited, personal, non‑exclusive, non‑transferable license to access and use the Services for your own non‑commercial purposes, subject to these Terms.
You may not remove proprietary notices or use PeakVox trademarks without prior written permission. Any feedback you provide may be used by PeakVox to improve the Services without obligation to you, unless prohibited by law.
5. Health, Safety, and No Medical Advice
PeakVox provides laughter‑focused wellness education and experiences. The Services are not medical or mental health treatment and are not a substitute for professional diagnosis, therapy, or medical advice. Individual results vary.
Laughter practices are generally gentle, but you should use your best judgment and stop any activity that causes pain, dizziness, shortness of breath, or discomfort. Consult a qualified clinician if you have concerns, are pregnant, have cardiovascular or respiratory conditions, have a history of fainting, or have any condition that may be affected by breathing or physical exertion.
6. Prohibited Conduct
You agree not to: (a) violate any law or regulation; (b) infringe intellectual property rights; (c) upload or transmit malicious code; (d) attempt to scrape, reverse engineer, or disrupt the Services; (e) harass, threaten, or harm others; (f) impersonate any person or entity; (g) share access credentials or paid materials without authorization; or (h) use the Services in a way that could reasonably cause harm to PeakVox or other users.
PeakVox may investigate suspected violations and may restrict, suspend, or terminate access as necessary to protect users, the Services, or PeakVox’s rights.
7. Third‑Party Links and Tools
The Services may reference or link to third‑party websites or tools. PeakVox does not control these third parties and is not responsible for their content, policies, or practices. Your interactions with third parties are governed by their own terms and privacy policies.
8. Disclaimer of Warranties
To the maximum extent permitted by law, the Services are provided on an “as is” and “as available” basis without warranties of any kind, whether express, implied, or statutory, including implied warranties of merchantability, fitness for a particular purpose, and non‑infringement. PeakVox does not warrant that the Services will be uninterrupted, error‑free, secure, or that any content will be accurate or complete.
9. Limitation of Liability
To the extent permitted by law, PeakVox and its directors, employees, contractors, and partners will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits, revenue, data, goodwill, or other intangible losses arising out of or related to your use of the Services.
To the extent permitted by law, PeakVox’s total liability for all claims arising out of or related to the Services will not exceed the amount you paid to PeakVox for the Services giving rise to the claim during the twelve (12) months preceding the event that first gave rise to liability, or one hundred U.S. dollars (US$100), whichever is greater.
10. Indemnification
You agree to indemnify and hold harmless PeakVox and its affiliates, officers, directors, employees, and contractors from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorneys’ fees) arising from or related to your misuse of the Services, your violation of these Terms, or your infringement of any rights of another.
11. Termination
PeakVox may suspend or terminate your access to the Services at any time if it reasonably believes you have violated these Terms or if required to protect the Services or other users. You may stop using the Services at any time. Sections intended by their nature to survive termination (including intellectual property, disclaimers, limitation of liability, and indemnification) will survive.
12. Changes to These Terms
PeakVox may update these Terms from time to time. Changes will be effective when posted on this page. Your continued use of the Services after changes are posted constitutes acceptance of the updated Terms.
